Job Description:

Under the direct supervision of the Chief Legal Counsel, the Sr. Legal Services Attorney advises and represents school districts and county offices of education on legal education issues and collective bargaining.


ESSENTIAL DUTIES & RESPONSIBILITIES

  • --Advises on Board issues and attends Board meetings
  • Researches and provides legal opinions both formal and informal, and in oral and written form
  • Reviews, drafts and revises district letters, correspondence, and inquires, responses
  • Reviews documents relating to specific matters
  • Assists clients with and participates in labor negotiations
  • May conducts investigations and prepares findings
  • Reviews and revises contracts
  • Assists Boards with superintendent issues, including evaluations, negotiating contracts (new/renewal), and separations
  • Maintains detailed notes and accurate files
  • Prepares and presents reports to various boards, commissions, and department contacts
  • Attends all necessary legal proceedings
  • Files legal actions for and defends legal actions against the named clients
  • Represents clients in federal and state courts and administrative forums
  • Prepares and processes all necessary court documents for assigned cases
  • May prepare cases for trial and negotiate dispositions
  • Assists departments and other contacts in preparing documentation
  • Prepares and assists in preparing contracts and legal agreements for assigned areas
  • Assists with Education Legal Alliance activities
  • Works closely with CSBA members and staff to provide guidance and respond to inquiries
  • Uses case management system to track billable time in a manner consistent with the mission and vision of the legal services program
  • Complies with CSBA Legal Services Protocols and Procedures
  • Represents the department at workshops, conferences and meetings with CSBA members, other elected officials, regulatory agencies, and education-related entities
  • May develop, draft and review board policies and administrative regulations
  • May also support legal department in providing corporate legal duties under the direction of the General Counsel & Chief of Staff, as needed
  • Performs related duties as assigned

    QUALIFICATIONS

    Knowledge of:

    • Applicable--Federal, State, and local policies, procedures, laws, regulations--applicable to education
    • Collective Bargaining and Negotiation procedures and practices
    • Interest based bargaining
    • Legal research methods, practices, and techniques
    • Technology applications as used within the Legal Services department
    • Ethical standards
    • Principles, practices, and trends in public, elementary, secondary, and post-secondary education
    • California and federal laws relating to public, elementary, secondary, and post-secondary education
    • Sources of information related to a broad range of education policy and programs
    • Legal principles and procedures, including civil and administrative laws and procedures
    • Federal, State, and local trial and appeal procedures and methods of case preparation, presentation, and rules of evidence
    • General office practices and procedures, including filing and the operation of standard office equipment record keeping practices
    • California State K-12 educational system

      Ability to:

      • Present statement of fact, law, and argument clearly and logically in written/oral form
      • Analyze situations accurately and adopt an effective course of action
      • Analyze and advise clients on Collective Bargaining agreements, policies, processes and procedures
      • Negotiate and bargain positions on behalf of clients
      • Analyze and advise clients on administrative/operational issues and make effective legal and/or procedural recommendations
      • Assist in developing and administering policies and procedures related to the department
      • Utilize appropriate interpersonal style and methods of communication to gain acceptance, cooperation, or agreement of a plan, activity, and/or program idea
      • Monitor current and proposed--Federal, State, and local policies, procedures, laws, regulations, and legislation--which impact education
      • Establish and maintain effective work relationships with those contacted in the performance of required duties
      • Use sound independent judgment within established policy and procedural guidelines
      • Recommend and implement goals, objectives, and practices for providing effective and efficient services
      • Effectively convey information to all levels of management, public audiences, and/or boards of directors
      • Work effectively with a diverse group of internal and external customers
      • Define problems, collect data, establish facts, and draw valid conclusion
      • Research, interpret, apply, explain, and ensure compliance with--Federal, State, and local policies, procedures, laws, regulations
      • Evaluate and develop improvements in operations, procedures, policies, or methods
      • Prepare clear and concise reports, correspondence, policies, procedures, and other written materials
      • Analyze, interpret, summarize, and present technical information and data in an effective manner
      • Conduct complex research projects, evaluate alternatives, make sound recommendations, and prepare effective technical staff report.
      • Effectively represent clients in meeting with governmental agencies, community groups, and various businesses, professional, and regulatory organizations, and in meetings with individuals
      • Establish and maintain variety of filing, record-keeping and tracking systems
      • Organize and prioritize a variety of projects and multiple tasks in an effective and timely manner; organize own work, set priorities, and meet critical time deadlines
      • Operate modern office equipment including computer equipment and specialized software applications program.
      • Use English effectively to communicate in person, over the telephone, and in writing
      • Use tact, initiative, prudence, and independent judgment within general policy, procedural and legal guidelines; establish, maintain, and foster positive and effective working relationships with those contacted in the course of performing duties and responsibilities

        SUPERVISORY RESPONSIBILITIES

        • This position provides for a wide variety of independent decision-making, within legal and general policy and regulatory guidelines.--

          EDUCATION & EXPERIENCE

          • Licensed to practice law and member of the California State Bar
          • Minimum of five (5) to seven (7) years of legal experience
          • Three (3) years of labor negotiation experience
          • Three (3) years of education law experience
          • Three (3) years of labor and employment experience preferred
          • Three (3) years of litigation experience preferred

            ENVIRONMENTAL ELEMENTS & PHYSICAL DEMANDS

            • Employee may travel throughout California
            • Employee works in a primarily sedentary office environment with moderate noise levels, controlled temperature conditions, and no direct exposure to hazardous physical substances.
            • Employee is personally responsible for following health and safety guidelines, instructions, and policies.
            • Must possess mobility to work in a standard office setting and use standard office equipment, including a computer; vision to read printed materials and computer screen, and hearing and speech to communicate in person, and over the telephone; must be able to bend, stoop, kneel, reach, push and pull drawers open and closed in the execution of duties.
            • Must be able to sit at computer for long periods of time and have the dexterity to access, enter, and retrieve data using a computer keyboard or calculator, and operate standard office equipment.
            • Employee must possess the ability to lift, carry, push, and pull materials and objects weighing up to 25 pounds, hand truck available to assist.

              LICENSES & CERTIFICATIONS

              • Possession of, or ability to, obtain a valid California Driver's license by time of appointment.
              • Active member in good standing with the State Bar of California.
